1. Introduction
Welcome to the Beyond Limits Learning Hub, a purpose-built platform designed to facilitate staff training and deliver ongoing support to carers, parents, and educators, making therapy more accessible and consistent for patients of Beyond Limits Paediatric Therapy.
These Terms of Use (“Terms”) govern your access to and use of the Beyond Limits Learning Hub app and website (collectively, the “Platform”). By accessing, downloading, registering for, or using the Platform, you agree to these Terms, our Privacy Policy, and any additional notices or policies made available within the Platform. If you do not agree, you must not use the Platform.
2. Who May Use the Platform
By accessing or using the Platform, you confirm that you:
are at least 18 years old, or have consent from a parent or guardian where the practice expressly permits use by persons under 18;
have the authority to use the Platform in your capacity as a clinician, carer, parent, teacher, or authorised organisation staff member; and
if providing information relating to a child, are the parent, guardian, or authorised adult with lawful authority to do so.
The Platform is not directed to use by children without the active involvement and supervision of a parent, guardian, or other legally authorised adult.
3. Purpose and Nature of the Platform
Beyond Limits provides:
expert therapy training for clinicians across multiple disciplines;
practical guidance and educational resources for carers, parents, and teachers; and
tools for creating, managing, and assigning learning modules, tracking progress, and supporting children more effectively.
The Platform is for educational and informational purposes only. It is not a crisis service, emergency service, diagnostic tool, treatment platform, or substitute for individualised assessment, intervention, or professional advice.
Unless expressly stated otherwise in a separate written clinical services agreement, the Platform does not provide personal medical advice, diagnosis, treatment, prescribing, clinical monitoring, or emergency triage.
4. General Information Only
All information made available through the Platform is general in nature only. It is not tailored to the specific needs, diagnosis, presentation, medical history, or developmental profile of any individual child or family. Content is provided for information and education only and must not be treated as personal medical, allied health, psychological, behavioural, educational, or legal advice.
If any content refers to symptoms, conditions, medications, feeding, behaviour, mental health, or developmental concerns, it is intended only as general educational material and must not be relied on as a basis for diagnosis, treatment, or urgent decision-making.
5. No Therapeutic or Clinical Relationship
Use of the Platform, including watching videos, reading resources, or communicating through the Platform, does not create an occupational therapist-client, speech pathologist-client, psychologist-client, physiotherapist-client, or other clinician-client relationship.
No doctor-patient, therapeutic, or other clinical duty to provide diagnosis, treatment, follow-up, or emergency response arises solely from use of the Platform. Any clinical relationship will arise only if expressly accepted by the relevant practitioner under a separate appointment, registration, consent, and service arrangement.
6. Seek Professional Advice
You acknowledge that you are responsible for obtaining your own independent advice from a suitably qualified professional regarding your child or family member's specific circumstances. You must not delay seeking professional advice, disregard professional advice, or make important clinical, educational, or care decisions solely on the basis of Platform content.
7. Emergency and Urgent Situations
The Platform is not intended for emergencies or urgent situations and is not monitored continuously. If there is a medical emergency, safety risk, mental health crisis, or any urgent concern, contact the appropriate emergency service immediately.
In Australia, this may include calling 000, attending the nearest hospital emergency department, or contacting a treating medical practitioner or relevant crisis service. Do not use the Platform for time-critical communications.
8. Child Supervision and Safety
Many activities, strategies, games, exercises, sensory ideas, and movement-based tasks may involve physical, emotional, behavioural, or environmental risks if used incorrectly or without proper supervision. You are solely responsible for:
supervising any child undertaking any activity referenced in the Platform;
assessing whether the activity is suitable for the individual child;
ensuring the environment is safe; and
stopping any activity if there is any risk of harm, distress, discomfort, dysregulation, fatigue, pain, or adverse reaction.
You must also ensure that any activity is appropriate having regard to the child’s age, developmental stage, diagnosed and undiagnosed conditions, allergies, medications, mobility, equipment needs, and any directions given by treating practitioners.
9. Progress Tracking
The Platform allows clinicians and authorised staff to create, assign, and track training modules. Carers, parents, and teachers may receive resources tailored to a child’s needs. Progress tracking is for informational and support purposes only and should not replace professional judgement or clinical assessment.
10. User Accounts
You may need an account to access certain features. You are responsible for:
maintaining the confidentiality of your login details;
ensuring all information provided is accurate and current;
all activity conducted under your account; and
promptly notifying us of any unauthorised use of your account or any security breach.
11. Acceptable Use
You must not use the Platform in any unlawful, misleading, abusive, defamatory, harmful, or unauthorised way. You must not:
copy, reproduce, scrape, reverse engineer, republish, commercialise, or redistribute any Platform content except where expressly permitted in writing;
upload material that is inaccurate, offensive, infringing, harmful, or otherwise inappropriate;
seek emergency advice, transmit spam or malicious code, or interfere with security or functionality;
impersonate another person or infringe another person’s privacy; or
upload health information or personal information about another person unless you are authorised to do so.
12. Intellectual Property
All intellectual property rights in the Platform, including videos, written materials, branding, layout, graphics, templates, and other content, remain the property of Beyond Limits Paediatric Therapy Pty Ltd or its licensors. You are granted a limited, revocable, non-exclusive, non-transferable licence to use the Platform for your own personal, non-commercial use in accordance with these Terms.
Content created or uploaded by clinicians or staff (“User Content”) remains their property; however, by uploading, you grant Beyond Limits a non-exclusive licence to store, display, and deliver this content to authorised users as part of Platform functionality.
13. Notifications
The Platform may send push notifications or email alerts related to new training assignments, updates to content, progress tracking, and account or system changes. You may adjust notification preferences within your device settings where applicable.
14. Third-Party Services
The Platform may incorporate or link to third-party platforms, payment providers, analytics tools, or other services. We are not responsible for the availability, security, privacy practices, or content of any third-party service. Your use of any third-party service may also be subject to that provider’s separate terms and privacy practices.
15. Assumption of Risk and No Guarantee of Outcomes
You acknowledge that use of the Platform and implementation of any activity, strategy, or suggestion carries inherent risk. To the maximum extent permitted by law, you voluntarily assume all risks associated with use of the Platform and any action taken in reliance on Platform content.
We do not warrant or guarantee that any content, strategy, activity, or educational resource will produce a particular outcome. Children respond differently, and what may be appropriate in one context may be inappropriate in another.
16. Disclaimer of Warranties
Except to the extent rights cannot lawfully be excluded under Australian law, the Platform and all content are provided on an ‘as is’ and ‘as available’ basis. We exclude all representations, warranties, and guarantees not expressly set out in these Terms, including implied warranties of fitness for purpose, accuracy, reliability, completeness, and non-infringement.
17. Limitation of Liability
Except to the extent rights cannot lawfully be excluded under Australian law, Beyond Limits Paediatric Therapy Pty Ltd, its directors, officers, employees, contractors, agents, and related entities are not liable for any loss, damage, liability, cost, claim, or expense arising out of or in connection with the Platform, including any reliance on Platform content, any use or misuse of the Platform, any activity undertaken after viewing Platform content, any interruption to the Platform, or loss of data.
Where a law implies a guarantee or imposes rights that cannot be excluded, our liability is limited, to the maximum extent permitted by law, to resupplying the relevant services or content, or paying the reasonable cost of having the relevant services or content resupplied.
18. Release and Indemnity
To the maximum extent permitted by law, you release us from, and agree to indemnify and hold harmless Beyond Limits Paediatric Therapy Pty Ltd and its directors, officers, employees, contractors, agents, and related entities against any claim, loss, liability, damage, cost, or expense arising directly or indirectly from your use of the Platform, your breach of these Terms, your reliance on Platform content, or your supervision or implementation of any activity involving a child.
19. Service Availability and Changes
We may update, suspend, restrict, replace, or discontinue any feature, content, or functionality of the Platform at any time. We do not guarantee uninterrupted or error-free access. We may also suspend or terminate your access if we reasonably believe you have breached these Terms or created a risk to the Platform, other users, or our business.
20. Changes to These Terms
We may update these Terms from time to time. The most current version made available through the Platform or website will apply from the date of publication. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms. For material changes, we may provide notice within the Platform or by email.
21. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from them.
22. Severability
If any clause of these Terms is held to be invalid, illegal, or unenforceable, that clause will be severed and the remaining clauses will continue in full force.
20. Changes to These Terms
We may update these Terms from time to time. The most current version made available through the Platform or website will apply from the date of publication. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms. For material changes, we may provide notice within the Platform or by email.
